TURN 9 GOLF TERMS OF SERVICE

1. Introduction

These Terms of Service ("Terms") are a legal agreement between you and Turn 9 Golf LLC ("Turn 9 Golf," "we," "us," or "our"). These Terms govern your access to and use of https://turn9golf.com and any related webpages, features, content, and services that link to these Terms (collectively, the "Site"), including purchases made through the Site.

"You" and "your" mean any individual or legal entity that visits, accesses, browses, creates an account on, or makes a purchase through the Site. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. If you use the Site on behalf of a company or other organization, you represent that you are authorized to bind that organization to these Terms.

3. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on the Site with a revised effective date and will apply prospectively from the date they become effective. Your continued use of the Site after updated Terms become effective constitutes your acceptance of them. Changes will not apply retroactively to a dispute of which the parties had actual notice before the updated Terms became effective.

4. Site Use and Accounts

You agree to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. Notify us promptly at support@turn9golf.com if you believe your account has been accessed without authorization.

You may use the Site only for lawful purposes. You may not:

(a) violate any applicable law or regulation;
(b) interfere with the Site's operation or security;
(c) attempt to gain unauthorized access to the Site or related systems;
(d) use automated tools to scrape, copy, or extract Site content except as permitted by law;
(e) introduce malware or other harmful code;
(f) impersonate another person or misrepresent your affiliation; or
(g) use the Site or its content to infringe the rights of another person.

We may suspend or terminate access to the Site when we reasonably believe these Terms have been violated or when necessary to protect the Site, Turn 9 Golf, our customers, or others.

5. Products and Product Information

We make reasonable efforts to display product descriptions, photographs, colors, sizes, and other details accurately. However, the appearance of products may vary depending on your device and display settings. Minor variations may also occur between products or production runs.

Prices, product descriptions, promotions, and availability may change without notice. We do not guarantee that every product or feature will remain available.

6. Orders, Pricing, and Payment

Your order is an offer to purchase. We may accept, reject, limit, or cancel an order for legitimate reasons, including product unavailability, suspected fraud, pricing or description errors, or limits on quantities. An automated order confirmation acknowledges receipt of your order but does not necessarily constitute acceptance. If we cancel an order after payment has been processed, we will issue a refund to the original payment method.

You agree to pay all prices, shipping charges, and applicable taxes shown at checkout. Payments are processed through third-party payment providers. We do not directly store complete payment-card information. Your use of a third-party payment service may also be governed by that provider's terms and privacy policy.

7. Shipping, Returns, and Refunds

Shipping estimates are not guarantees unless we expressly state otherwise. Risk of loss and title to purchased products pass as provided by applicable law. Our current shipping, return, exchange, and refund policies, as posted on the Site, are incorporated into these Terms. If there is a conflict between these Terms and a product-specific written policy presented at checkout, the product-specific policy controls for that purchase.

Nothing in these Terms limits any warranty, refund, cancellation, or other consumer right that cannot lawfully be limited or waived.

8. Promotions and Discount Codes

Promotions, contests, giveaways, and discount codes may be subject to additional terms. Unless stated otherwise, discount codes have no cash value, cannot be combined, and may be limited or withdrawn as permitted by law. We may refuse or cancel the misuse of a promotion or discount code.

9. Errors, Inaccuracies, and Omissions

The Site may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, promotions, shipping charges, transit times, or availability. To the extent permitted by law, we may correct such information, update the Site, or cancel affected orders. If an affected order has already been charged and is canceled, we will refund the amount paid for the canceled item or order.

10. Reviews, Feedback, and Other Submissions

If you voluntarily submit suggestions, ideas, or other feedback about Turn 9 Golf or the Site ("Feedback"), you grant us a perpetual, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, and incorporate that Feedback for any lawful purpose without compensation to you.

If you submit a product review, photograph, video, comment, or other content for publication ("User Content"), you retain your ownership rights. You grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, modify for formatting, publish, display, distribute, and use that User Content in connection with operating, improving, and promoting Turn 9 Golf and its products. You represent that you have the rights needed to grant this license and that your User Content does not violate law or another person's rights.

We may moderate or remove User Content that violates these Terms, is unlawful, contains confidential information, or is fraudulent, abusive, obscene, or unrelated to the product or service being reviewed. We will not prohibit or penalize honest consumer reviews merely because they are negative.

11. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy. Please review the Privacy Policy before using the Site. If you do not yet have a Privacy Policy, do not publish this section without first creating and posting one.

12. Intellectual Property

The Site and its content—including text, graphics, photographs, designs, logos, product names, software, and other materials—are owned by or licensed to Turn 9 Golf and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, noncommercial shopping purposes.

No Turn 9 Golf trademark, logo, product image, or other protected content may be copied, reproduced, modified, distributed, displayed, sold, or otherwise exploited without our prior written permission, except as allowed by law.

13. Third-Party Links and Services

The Site may contain links to third-party websites or services. We do not control and are not responsible for their content, availability, security, privacy practices, or terms. Your use of a third-party website or service is at your own risk and subject to its applicable terms.

14. Site Availability

We do not guarantee uninterrupted or error-free access to the Site. We may modify, suspend, restrict, or discontinue all or part of the Site for maintenance, security, operational, or business reasons, subject to applicable law. We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, labor disputes, utility or telecommunications failures, cyberattacks, government actions, transportation interruptions, or supplier failures.

15. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT, AS DISTINCT FROM PRODUCTS PURCHASED THROUGH THE SITE, ARE PROVIDED "AS IS" AND "AS AVAILABLE." TURN 9 GOLF DISCLAIMS WARRANTIES REGARDING THE OPERATION OF THE SITE, INCLUDING IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THIS DISCLAIMER DOES NOT EXCLUDE OR MODIFY ANY EXPRESS PRODUCT WARRANTY OR ANY IMPLIED WARRANTY, REMEDY, OR OTHER CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED, MODIFIED, OR WAIVED. IN PARTICULAR, TURN 9 GOLF DOES NOT DISCLAIM THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE APPLICABLE TO CONSUMER GOODS UNDER MASSACHUSETTS LAW.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TURN 9 GOLF AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, TURN 9 GOLF'S TOTAL LIABILITY FOR A CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TURN 9 GOLF FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM OR (B) $100.

THE EXCLUSIONS AND CAP ABOVE DO NOT APPLY TO PERSONAL INJURY, TURN 9 GOLF'S FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT, OR ANY PRODUCT-WARRANTY REMEDY, STATUTORY CONSUMER-PROTECTION REMEDY, OR OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. Some jurisdictions do not allow certain warranty exclusions or limitations of liability. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted by law.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Turn 9 Golf and its owners, officers, employees, agents, affiliates, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from your unlawful use of the Site, your material violation of these Terms, your User Content, or your violation of another person's rights. This section does not require you to indemnify any party for that party's own fraud, willful misconduct, or other conduct for which indemnification is prohibited by law.

18. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Site will be governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. Subject to any consumer rights that require otherwise, the state courts located in Worcester County, Massachusetts, and the United States District Court for the District of Massachusetts will have exclusive jurisdiction, and you consent to personal jurisdiction and venue in those courts.

19. Waiver and Severability

Our failure to enforce a provision of these Terms is not a waiver of that provision or any other provision. If a court finds any provision invalid or unenforceable, that provision will be enforced to the maximum extent permitted or limited as necessary, and the remaining provisions will remain in effect.

20. Entire Agreement and Assignment

These Terms and the policies expressly incorporated into them constitute the entire agreement between you and Turn 9 Golf concerning the Site. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.

21. SMS Terms

This section applies only if you enroll in a Turn 9 Golf text-messaging program. By opting in, you consent to receive recurring automated marketing text messages from or on behalf of Turn 9 Golf at the telephone number you provide. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

You may opt out at any time by replying STOP to a Turn 9 Golf message. You may also use another reasonable method communicated to us to revoke your consent. After opting out, you may receive a one-time confirmation message. Reply HELP for assistance or contact support@turn9golf.com. Your participation in the text-messaging program is also subject to our Privacy Policy.
